By accessing or using VieraStudy ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must discontinue use of the Platform immediately.

2. Eligibility

You must meet one of the following requirements to use VieraStudy:

• Be 18 years of age or older, or
• Be 13 years of age or older with verifiable parental or guardian consent

By creating an account, you confirm that you meet these eligibility requirements. Users under 13 years of age are strictly prohibited from using the Platform.

3. No School Affiliation

VieraStudy is an independent online study platform and is not affiliated with, endorsed by, or connected to any school, school district, educational institution, or academic organization. All tools and services are provided independently.

4. Platform Features & Services

VieraStudy provides the following features to enhance your study experience:

• Classes Management: Organize and track your academic courses
• Flashcards: Create, study, and master flashcard decks with spaced repetition
• Notes: Write, organize, and sync your study notes
• Todo List: Manage tasks and assignments
• Schedule: Track events, deadlines, and study sessions
• Progress Tracker: Monitor your academic progress and goals
• Pomodoro Timer: Use focused study sessions with break intervals
• Calculators: Access scientific and graphing calculators
• AI Features: Grammar checking, essay scoring, and study assistance

5. Account Management

We reserve the right to disable, suspend, or terminate your account at any time, for any reason or no reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Abuse of Platform features or resources
• Harassment of other users
• Security concerns or suspicious activity

Account termination may occur without prior notice. We may cancel any subscription or paid plan at our sole discretion.

6. Subscriptions & Payment Policy

Free Access: VieraStudy currently offers all features free of charge. We reserve the right to introduce paid subscriptions or premium features in the future.

Future Paid Features: If we introduce paid subscriptions:

• Subscriptions can be canceled at any time by you or by VieraStudy
• All payments are final and non-refundable under any circumstances
• No refunds will be provided for partial periods, unused services, or any other reason
• Pricing and features may change with 30 days notice to active subscribers

7. User-Generated Content & Acceptable Use

You are solely responsible for all content you create, upload, or share on VieraStudy. You agree that:

• All content must comply with applicable local, state, and federal laws
• You will not use the Platform to cheat, plagiarize, or violate academic integrity policies
• You will not share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
• You will not upload malicious code, viruses, or attempt to compromise Platform security
• You will not impersonate others or create fake accounts
• You will not use the Platform to harass, stalk, or harm other users
• You will use AI features responsibly and in accordance with your school's academic policies

We reserve the right to remove any content that violates these rules without notice.

8. Data Security & Privacy

Your data security and privacy are important to us:

• All user data is encrypted at rest and in transit using industry-standard protocols
• Passwords are hashed using SHA-256 before storage
• Your data will never be sold to third parties
• We implement strict access controls and security monitoring
• Upon account deletion, all personal data is permanently deleted from our systems

9. AI Features & Content

VieraStudy offers AI-powered features including grammar checking, essay scoring, and study assistance:

• AI-generated content is processed in real-time and not stored on our servers
• AI responses are provided for educational purposes and may contain errors
• You are responsible for verifying all AI-generated content
• We do not use your AI interactions to train models or share with third parties
• AI features should be used as study aids, not to complete assignments dishonestly

10. Intellectual Property

All Platform content, features, design, code, logos, and trademarks are owned by VieraStudy and protected by United States and international intellectual property laws. You agree that:

• You may not copy, modify, distribute, sell, or reverse engineer any part of the Platform
• You may not use VieraStudy branding without written permission
• You retain ownership of content you create, but grant us a license to store and display it
• You may export your content at any time through account settings

11. Limitation of Liability

VieraStudy is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy, reliability, or availability of the Platform
• Warranties that the Platform will be uninterrupted or error-free

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages
• We are not liable for data loss, academic consequences, or missed deadlines
• We are not responsible for third-party services or links
• Our total liability shall not exceed $100 or the amount you paid us in the past 12 months

12. Indemnification

You agree to indemnify and hold harmless VieraStudy, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use or misuse of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or share on the Platform

13. Arbitration & Dispute Resolution

Agreement to Arbitrate: You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.

Arbitration Rules: Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitrator's decision will be final and binding.

Opt-Out Right: If you are a new user, you may reject and opt-out of this Arbitration Agreement within 30 days of accepting these Terms by emailing us at [email protected] with your first and last name and stating your intent to opt-out. Opting out does not affect any other part of these Terms.

Class Action Waiver: You agree to bring claims only in your individual capacity and not as part of any class or representative action.

14. Modifications to Platform & Service

We reserve the right to:

• Modify, suspend, or discontinue any feature or service at any time
• Change pricing structures with reasonable notice
• Update system requirements or supported browsers
• Perform maintenance that may temporarily disrupt service

We will make reasonable efforts to notify users of significant changes.

15. Changes to Terms

We may update these Terms of Service at any time. When we make changes:

• We will update the "Effective Date" at the top of this page
• Significant changes will be communicated via email or Platform notification
• Continued use of VieraStudy after changes constitutes acceptance of the new Terms
• If you do not agree to the changes, you must stop using the Platform

16. Termination

You may terminate your account at any time through account settings. Upon termination:

• Your access to the Platform will be immediately revoked
• All your data will be permanently deleted within 30 days
• Any paid subscriptions will be canceled without refund
• These Terms will continue to apply to past use of the Platform

18. Severability
